Terms of Service
1 Acceptance of Terms
By accessing or using any part of the KodeCryptX platform, KodeVault, CipherCast, NexusPlayer, LifeOps, EternalCast, EternalBeat, EternalPix, CastComm, or any associated editors, APIs, or services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.
If you do not agree with any part of these Terms, you must discontinue use of the Platform immediately. Your continued use of the Platform constitutes ongoing acceptance of the current Terms.
The Platform is operated by KingKode ("we", "us", "our"), an independent software operation based in Australia.
2 Platform Description
KodeCryptX is a unified, local-first developer and creator platform. The Platform currently includes:
- KodeVault: An Android app marketplace for KingKode apps β browse, download, and manage KingKode applications including CipherCast, NexusPlayer, and LifeOps.
- Repositories: Version-controlled storage for code, datasets, AI models, and media assets with public/private visibility controls.
- Creative Suite: Browser-based editors β Vidinator (video), Pixinator (photo), Beatinator (audio/beats), ProtoX (UI prototyping), DocTator (documents), PDFTator (PDF), and TableTator (spreadsheets).
- EternalCast / EternalBeat / EternalPix: Media sharing and community streaming hubs for video, music, and photography.
- CastComm: A community feed and real-time group chat platform.
- Developer Portal & API: Token-based REST API for programmatic access to Platform features.
- Wallet: Integration with the ARK blockchain ecosystem for digital asset management.
We reserve the right to add, modify, suspend, or remove Platform features at any time. We will endeavour to provide reasonable advance notice for significant removals that affect existing user data or workflows.
3 Accounts & Security
3.1 Registration
To access most Platform features, you must register an account. You agree to provide accurate and complete information during registration and to keep this information up to date. Usernames must be 3β32 characters, must not impersonate another person or entity, and must not contain offensive or misleading terms at our sole discretion.
3.2 Account Security
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:
- Use a strong, unique password of at least 8 characters.
- Notify us immediately at [email protected] if you suspect unauthorized access to your account.
- Not share your login credentials or session token with any third party.
- Not use automated bots or scripts to create accounts.
We are not liable for any loss or damage arising from your failure to safeguard your credentials.
3.3 One Account Per Person
Each person may maintain one account. Creating multiple accounts to circumvent suspensions, bans, or rate limits is prohibited and may result in permanent removal of all associated accounts.
3.4 Account Roles
Accounts are assigned a role: user (default), guardian, or founder. Role assignments are at the sole discretion of KingKode. Elevated roles carry additional responsibilities and must not be misused.
4 Your Content & Intellectual Property
4.1 Ownership
You retain full ownership of all content you create, upload, or publish on the Platform ("User Content"), including repositories, code, datasets, models, media files, posts, and listings. These Terms do not transfer any ownership of your intellectual property to KingKode.
4.2 Licence to KingKode
By uploading or publishing User Content, you grant KingKode a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, reproduce, transmit, and display your content solely as necessary to operate, maintain, and improve the Platform. This licence terminates when you delete your content or close your account (subject to technical caching delays of up to 30 days).
4.3 Public Content
Content you publish with "public" visibility is accessible to all users and may be indexed by search engines. You are responsible for ensuring that public content does not violate any third-party intellectual property rights or applicable law.
4.4 Open Source & Licences
You are responsible for applying appropriate licences to your repositories. KingKode does not impose a default licence on unlicensed repositories; absence of a licence does not grant others permission to use your code under any open-source terms.
4.5 Representations
By uploading User Content, you represent and warrant that: (a) you own or have the necessary rights to the content; (b) the content does not infringe any third-party intellectual property rights; (c) the content does not violate any applicable law; and (d) you have obtained all required consents for any personal data included in the content.
5 Acceptable Use Policy
You may use the Platform only for lawful purposes consistent with these Terms. The following illustrates what is and is not permitted:
- Hosting personal, open-source, or commercial code projects
- Sharing datasets and AI models with appropriate licences
- Publishing original creative media (video, music, photos)
- Building apps that use the Platform API within rate limits
- Participating in community features respectfully
- Using creative editors for personal or professional work
- Automated access via API tokens within documented limits
- Uploading malware, ransomware, or malicious code
- Distributing content that infringes copyright or trademarks
- Hosting child sexual abuse material (CSAM) β zero tolerance
- Scraping, crawling, or harvesting without permission
- DDoS attacks, brute-force attacks, or exploiting vulnerabilities
- Impersonating KingKode, another user, or a public figure
- Spam, phishing, or fraudulent content of any kind
- Circumventing rate limits, access controls, or suspensions
- Using the Platform to facilitate illegal activity
- Uploading personally identifiable data without consent
We reserve the right to remove any content that violates this Policy, suspend accounts, and report violations to relevant authorities, without prior notice where the violation is serious.
6 KodeVault Marketplace
6.1 App Distribution
KodeVault is an Android app marketplace operated by KingKode for distributing KingKode applications. Apps distributed through KodeVault are developed and maintained by KingKode.
6.2 Third-Party Marketplace Listings
The Platform may allow approved publishers to list apps, services, datasets, code packages, or media for sale or distribution in the marketplace. As a publisher, you represent that your listing: (a) complies with all applicable laws; (b) does not infringe third-party rights; (c) accurately describes the product; and (d) does not contain malicious code or deceptive functionality.
6.3 Downloads & APKs
Android applications downloaded from the Platform are provided for direct installation (sideloading). You acknowledge that installing APKs from outside the Google Play Store requires enabling installation from unknown sources on your device, and you do so at your own risk. We warrant that our official APKs are free from malware and are the genuine, unmodified releases.
6.4 No Warranty on Third-Party Listings
For any third-party marketplace listings, KingKode acts as a platform facilitator only. We do not endorse, warrant, or guarantee the quality, safety, or legality of third-party content. Any transactions or disputes arising from third-party listings are between you and the listing publisher.
6.5 Pricing & Payments
Where marketplace listings carry a price, payment terms (currency, refund policy, delivery) are set by the individual publisher and disclosed at the time of purchase. KingKode is not responsible for payment processing issues involving third-party publishers.
7 Community Features
7.1 CastComm & Chat
CastComm is a public community feed. Real-time Chat rooms are available to registered users. By participating, you agree to engage respectfully and not post content that is: abusive, harassing, threatening, defamatory, discriminatory, sexually explicit without appropriate content warnings, or otherwise in violation of section 5 (Acceptable Use).
7.2 EternalCast, EternalBeat & EternalPix
These media-sharing hubs allow users to upload and share video, music, and photography. By uploading media, you confirm that you own or are licensed to share it and that it does not violate any copyright, privacy rights, or community standards.
7.3 Content Moderation
We reserve the right to remove community content, issue warnings, mute, or ban users whose content or behaviour violates these Terms. Moderation decisions are made at our discretion. You may appeal a moderation action by contacting us at [email protected].
7.4 Public Visibility
Content posted to public community features (CastComm, public EternalCast videos, public EternalPix galleries) is accessible without authentication. Do not post sensitive personal information in public community spaces.
8 API & Developer Access
8.1 API Tokens
Registered users may generate API tokens via the Developer Portal. You are responsible for keeping your token secret. Tokens grant access equivalent to your user role β treat them as passwords. Do not commit tokens to public repositories or share them with unauthorised parties. Compromised tokens should be revoked immediately.
8.2 Permitted Use
You may use the API to: build applications that interact with your own content, automate your development workflow, access public platform data within rate limits, and integrate Platform features into your own projects.
8.3 Rate Limits & Fair Use
API access is subject to rate limits to ensure Platform stability for all users. Exceeding rate limits may result in temporary throttling or token suspension. If your use case requires higher limits, contact us to discuss enterprise or partner arrangements.
8.4 Prohibited API Use
You must not use the API to: scrape or mass-harvest user data, probe for security vulnerabilities, bypass authentication or access controls, create automated accounts, or build services that compete directly with Platform features without prior written authorisation.
8.5 API Changes
We may modify, deprecate, or remove API endpoints. We will provide at least 30 days' notice for breaking changes via the Developer Portal and changelog, except where immediate changes are required for security reasons.
9 Wallet & Digital Assets
9.1 ARK Integration
The Platform integrates with the ARK blockchain ecosystem. The wallet feature allows you to connect your ARK wallet address to your Platform account. KingKode does not operate a custodial wallet β we never store, control, or have access to your private keys.
9.2 Your Responsibility
You are solely responsible for the security and management of your private keys and wallet. Lost private keys cannot be recovered by KingKode. Blockchain transactions are irreversible β verify all transaction details carefully before confirming.
9.3 Volatile Assets
Digital assets (including ARK tokens) are highly volatile and speculative. Their value may decrease significantly. Nothing in these Terms or on the Platform constitutes financial, investment, legal, or tax advice. You use digital asset features entirely at your own risk.
9.4 Regulatory Compliance
You are responsible for complying with all applicable laws and regulations regarding digital assets in your jurisdiction, including tax-reporting obligations. The Platform does not provide tax reporting assistance.
9.5 Transaction Finality
Blockchain transactions initiated through the Platform are final once confirmed by the network. KingKode cannot reverse, cancel, or refund blockchain transactions under any circumstances.
10 KingKode Intellectual Property
The Platform itself β including its code, design, branding (KingKode, KodeCryptX, KodeVault, CipherCast, NexusPlayer, LifeOps, EternalCast, EternalBeat, EternalPix, CastComm, Vidinator, Pixinator, Beatinator, ProtoX, DocTator, PDFTator, TableTator, ProtoX), logos, visual identity, and all Platform-developed software β is owned by KingKode and protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform solely as expressly permitted by these Terms. You must not:
- Copy, reverse-engineer, decompile, or create derivative works of Platform software (except to the extent permitted by applicable law).
- Use KingKode branding, logos, or trademarks without prior written consent.
- Remove or alter any proprietary notices or labels on the Platform.
- Claim affiliation with or endorsement by KingKode without written authorisation.
Open-source components of the Platform are governed by their respective licences, which take precedence over these Terms with respect to those specific components.
11 Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, store, and protect your personal information in accordance with the Australian Privacy Act 1988 (Cth).
By using the Platform, you consent to the data practices described in the Privacy Policy. If you do not agree with the Privacy Policy, you must discontinue use of the Platform.
12 Disclaimers & Warranties
To the maximum extent permitted by applicable law:
- The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied β including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.
- We do not warrant that the Platform will be error-free, secure, or free from harmful components.
- We do not warrant that data or content stored on the Platform will not be lost or corrupted β you are responsible for maintaining independent backups of critical data.
- Information and content on the Platform (including community posts, marketplace listings, and repository README files) are provided by users and third parties; we make no representations about their accuracy, completeness, or reliability.
- We are not responsible for the acts or omissions of third-party services integrated with the Platform (e.g., Cloudflare, ARK blockchain, SMTP providers).
Nothing in this clause limits rights you may have under consumer-protection laws in Australia (including the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded by contract.
13 Limitation of Liability
To the fullest extent permitted by applicable law, KingKode and its operators shall not be liable for:
- Any indirect, incidental, special, consequential, exemplary, or punitive damages.
- Loss of profits, revenue, data, goodwill, or business opportunities.
- Loss or corruption of user content, including repository data or uploaded media.
- Losses arising from unauthorized access to or alteration of your account or content.
- Losses arising from your use of, or inability to use, digital assets or blockchain features.
- Losses arising from reliance on Platform content (marketplace listings, community posts, etc.).
Where liability cannot be excluded under Australian Consumer Law, our aggregate liability to you for any claims arising from these Terms or your use of the Platform is limited to the greater of: (a) the total fees paid by you to KingKode in the 12 months preceding the claim; or (b) AUD $100.
14 Indemnification
You agree to indemnify, defend, and hold harmless KingKode and its operators from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable legal fees) arising from or relating to:
- Your User Content and its use by others on or through the Platform.
- Your violation of these Terms or any applicable law or regulation.
- Your infringement of any intellectual property or other rights of any third party.
- Your use of the Platform API in a manner that causes harm to KingKode or other users.
- Your use of the Wallet or digital asset features in violation of applicable regulations.
We reserve the right, at our own expense, to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defence of such claim.
15 Termination
15.1 By You
You may close your account at any time by contacting us at [email protected]. Upon account closure, your personal data will be handled in accordance with our Privacy Policy. Public repositories and community content may be retained for a grace period to allow downstream dependants to migrate, unless you explicitly request immediate deletion.
15.2 By KingKode
We may suspend or terminate your account, with or without notice, if we determine in good faith that you have:
- Violated these Terms or our Acceptable Use Policy.
- Engaged in activity that poses a security risk to the Platform or other users.
- Created legal exposure for KingKode.
- Failed to pay any amounts owed (for paid services, if applicable).
Where practical and where the violation is not serious or egregious, we will provide notice and a reasonable opportunity to cure the breach before terminating an account.
15.3 Effect of Termination
Upon termination, your right to access and use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including sections 4, 10, 12, 13, 14, and 16) shall continue to apply.
16 Governing Law & Dispute Resolution
16.1 Governing Law
These Terms and any dispute arising from your use of the Platform are governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict-of-law provisions.
16.2 Jurisdiction
You submit to the exclusive jurisdiction of the courts located in Victoria, Australia for resolution of any disputes arising from or related to these Terms or the Platform, except where mandatory consumer-protection laws of your jurisdiction grant you rights to bring proceedings locally.
16.3 Informal Resolution First
Before initiating formal legal proceedings, you agree to contact us at [email protected] and attempt in good faith to resolve the dispute informally for at least 30 days. Many disputes can be resolved quickly through direct communication.
16.4 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot lawfully be excluded or limited.
17 Changes to These Terms
We may modify these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page.
- Post a notice on the Platform for at least 14 days before the updated Terms take effect.
- Send an email notification to registered users with a verified email address where the change materially affects their rights or obligations.
Your continued use of the Platform after the effective date of revised Terms constitutes acceptance of those Terms. If you do not agree to the revised Terms, you must stop using the Platform and may request account deletion before the effective date.
For minor changes (such as typographical corrections or clarifications that do not alter the substance of these Terms), we may update this page without additional notice.
